Notice of Public Hearing
PLEASE TAKE NOTICE that the East Greenbush Town Board has scheduled a Public Hearing on a Proposed Local Law Imposing a Moratorium on Applications for Permits, Site Plans or Other Land Use Approvals for Data Centers on July 8, 2026, at 6:00 PM at the East Greenbush Town Hall, 225 Columbia Turnpike, Rensselaer, NY 12144.
Data Centers have been identified as an emerging land use with the potential to present adverse impacts on the health and wellbeing of residents of the Town of East Greenbush due to concerns related to water usage and quality, impacts on town infrastructure, impacts on the environment, public health and safety, noise generation, and community character.
The 2025 Comprehensive Zoning Law does not currently identify Data Centers as a specific use designation and does not include any specific regulations or standards for the siting and/or development of the use.
The Town Board wishes to solicit public comment on a proposal to initiate a moratorium on development of Data Centers to allow the Town Board sufficient time to adequately study and consider potential concerns related to the siting and development of Data Centers, including, but not limited to, zoning, environmental quality, town infrastructure, public health and wellbeing, water usage and quality, and energy usage.
The SEQRA regulations at 6 NYCRR Section 617.5(c )(32) provide that “adoption of a moratorium on land development or construction” is a Type II action.
The proposed local law would establish a moratorium on the receipt and consideration by the town of proposals for these projects for a period of 6 months from the effective date of the local law, with an additional authorized 6-month extension, if deemed necessary.
The Town Board of the Town of East Greenbush hereby schedules a Public Hearing to be held at the Town Hall, 225 Columbia Turnpike, Rensselaer, NY 12144 on July 8, 2026, at 6:00 p.m. regarding the proposed Local Law Imposing a Moratorium on Applications for Permits, Site Plans or Other Land Use Approvals for Data Centers.
A copy of the proposed Local Law can be viewed at the Town Clerk’s Office during regular business hours, or online at eastgreenbush.org.
Written comments may be submitted to the Town Board by email to [email protected], or by mail to the Town Board, Town of East Greenbush, 225 Columbia Turnpike, Rensselaer, New York 12144, at any time prior to the hearing.
